Terms of Service

Effective date: October 8, 2026

These terms govern your use of Fyndol, an all-in-one CRM and marketing platform for marketing agencies of any niche, operated by Scalevate Marketing LLC ("we", "us"). By using Fyndol, you agree to these terms.

1. Using Fyndol

You must be 18 or older to use Fyndol. Fyndol is not directed to children under 13 and does not knowingly collect their data. You must provide accurate account information and keep your login secure. You are responsible for activity under your account.

2. Acceptable use

• No spam, and no unlawful, deceptive, or harassing messages.
• Text messaging must follow the Telephone Consumer Protection Act (TCPA), carrier A2P 10DLC rules, and other applicable laws, including honoring opt-outs (such as STOP).
• Email must follow CAN-SPAM and similar laws.
• Use of Facebook, Instagram, and Google features must follow those platforms' terms and policies.
• No attempts to break, overload, or gain unauthorized access to Fyndol.

3. Your contacts and consent

You are responsible for the contact data you put into Fyndol and for getting any consent required before you text, call, or email your contacts. Fyndol helps with this (SMS consent checkboxes on forms, consent records on each contact, automatic unsubscribe links and your business address in marketing emails), but these tools do not replace your own legal obligations.

4. Your data

You own your data. You let us process it only to provide Fyndol, as described in our Privacy Policy.

5. No warranty

Fyndol is provided "as is" and "as available", without warranties of any kind, express or implied.

6. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us for Fyndol in the 12 months before the claim.

7. Termination

You can stop using Fyndol at any time. We may suspend or end access if these terms are broken or to protect the service or others.

8. Governing law

These terms are governed by the laws of the State of California, USA.

9. Changes

We may update these terms. We will post the new version here with a new effective date.
